In addition to the language below, these Terms include Google Fiber Inc.’s Terms of Service and Google Inc.’s Terms of Service.Payment Authorization
You authorize Google Fiber to automatically charge an additional $10 per month per device for 24 months, plus applicable taxes, from your designated payment method with Google Fiber, starting with the first invoice you receive after you pick up your Samsung Chromebook ("Chromebook"). If you cancel Service before all 24 payments have been made, you authorize a one time charge in the amount of the outstanding balance. The outstanding balance is calculated as $10/Chromebook (plus tax) multiplied by the remaining months in the 24 month period that began on the date of receipt of each Chromebook (“Outstanding Balance”).Contact Authorization
You grant Google Fiber permission to contact you via phone or email regarding device pickup details.Orders
Google Fiber reserves the right to reject your order. For example, Google Fiber may reject your order if you do not live in a fiberhood currently part of the promotion or if you order more than the permitted maximum number of Chromebooks or if orders exceed our limited quantities.Receipt Date
Google Fiber will contact you with instructions regarding where and when to pick up your Chromebook(s). When you pick up your Chromebook(s), you will be required to acknowledge that you received the Chromebook(s) on that date ("Receipt Date"). You will own the Chromebook(s) upon Receipt Date.Return Policy
If, for any reason, you do not wish to keep your Chromebook, you have up to 15 days from the Receipt Date to cancel your purchase. If you exercise your right of cancellation, you are responsible for returning the Chromebook as soon as possible and at your own cost. To initiate a return, please contact Google Fiber. You must take reasonable care of the items that you wish to return, and we require that you return the Chromebook with its original packaging and any accessories. Once Google Fiber has received your returned Chromebook(s), Google Fiber will refund your previous monthly payment (if any) and you will not be charged the Outstanding Balance.Restrictions
- You may not order more than the maximum number of Chromebooks specified.
- The Chromebook may be subject to import and export laws and regulations in the United States and elsewhere. You must comply with all domestic and international import and export laws and regulations that apply to your use of the Chromebook. These laws may include restrictions on destinations, users, and end use.
- You may only use the Chromebook in accordance with the instructions that come with it, including instructions that may be available on line. Google Fiber (or its parent entity, Google Inc.) may provide software updates/upgrades that you will need to install in order for your Chromebook and/or Google Fiber services to function properly, and the use of that software may be subject to additional licensing terms.
Resale and Gifts
You may not commercially resell the Chromebook, but you may give the Chromebook as a gift. These Terms shall also apply to any gift recipient.Internet Connectivity
You are solely responsible for obtaining access to the Internet through a wireless service provider or other Internet connectivity service provider, whose service is compatible with the Chromebook (such as Google Fiber). To access the Internet using the WiFi functionality, you understand that you will need access to a 802.11a/b/g/n access point Wi-Fi router (such as one included with Google Fiber).Hardware and Battery
Battery life depends on device settings, usage, and many other factors. Battery tests are conducted using specific Chromebook units; actual results may vary. You understand that the Chromebook may only be compatible with certain hardware accessories manufactured by third parties, and Google Fiber makes no warranty with respect to such hardware accessories. Actual formatted capacity of your Chromebook will be less than the listed capacity.Chromebook Warranty
The Chromebook is manufactured by Samsung Electronics Co., Ltd., whose principal place of business is at (Maetan dong) 129, Samsung-ro, Yeongtong-gu, Suwon-si, Gyeonggi-do 443-742, Korea, ("Samsung"). You acknowledge that Samsung, as the manufacturer of the Chromebook, provides a limited manufacturer's warranty for repairs and service of the Chromebook. Please refer to the warranty card in the Chromebook package or contact the Samsung support center for details on the Samsung Limited Warranty terms and how to make a claim under the Samsung Limited Warranty. This additional warranty does not affect your legal rights.Warranties; Disclaimer of Warranties
OTHER THAN THE WARRANTIES REFERRED TO HEREIN, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOOGLE FIBER, GOOGLE INC., AND THE DEVICE MANUFACTURERS EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, REGARDING ANY DEVICES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOOGLE FIBER, ITS PARENT, AND ITS SUBSIDIARIES AND AFFILIATES (COLLECTIVELY, "GOOGLE PARTIES") SHALL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY (WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES THAT MAY BE INCURRED BY YOU IN CONNECTION WITH THE DEVICE OR THESE TERMS, INCLUDING ANY LOSS OF DATA, WHETHER OR NOT A GOOGLE PARTY OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING. YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GOOGLE PARTIES' TOTAL LIABILITY IN CONNECTION WITH THE DEVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO GOOGLE FIBER UNDER THESE TERMS.
